Terms of Use

These terms cover the Penman app for iPhone, iPad, and Mac, and the website at penmanai.app including its free tools. By using either, you agree to these terms. If you don't agree, please don't use them.

The service

Penman is a voice-first note-taking app: live transcription, a rich-text editor, notebooks and Spaces, iCloud sync, and AI features such as summaries, flashcards, quizzes, and chat-with-your-notes. The website offers a separate set of free browser-based note-taking utilities. No account is required for either.

Your content

You own your content — notes, recordings, imports, and everything you create stay yours. Because notes are stored on your device and in your own iCloud account, you are responsible for your own backups and exports. When you invoke AI features, you grant us a limited right to transmit the relevant text to our AI provider solely to produce the requested output.

Subscriptions & billing

Penman is free to use; Penman Premium unlocks advanced features as an auto-renewing subscription or one-time purchase. All billing is handled by Apple through the App Store:

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Manage or cancel your subscription in your App Store account settings.
• Refunds are handled by Apple under its own policies — we can't issue them directly.
• If we change pricing, Apple will notify you and continued use requires your consent.

The Penman app is also governed by Apple's standardEnd User License Agreement; where that agreement and these terms conflict for the app, Apple's terms control.

AI-generated content

AI features — in the app and in the free tools — generate text automatically and can be wrong, incomplete, or out of date. Transcriptions may mishear words; summaries may miss nuance; flashcards and quizzes are study aids, not authoritative sources. Verify anything that matters. Nothing produced is medical, legal, or professional advice.

Acceptable use

Don't abuse the service. That means no:

• Unlawful use, or violating others' rights (including copyright in content you transcribe or import)
• Automated bulk use, scraping, or reverse-engineering of the AI endpoints
• Attempting to disrupt the site, the app, or their infrastructure
• Misrepresenting AI-generated output as human-authored where that would be deceptive

You're responsible for having the right to record and transcribe the audio you capture — recording laws vary by jurisdiction, and some require consent from everyone being recorded.

The free tools

The tools on this site are provided free of charge for personal and commercial use. Because they run entirely in your browser, you are responsible for keeping copies of anything important — clearing your browser data erases locally saved content. We may rate-limit or suspend the AI tools to prevent abuse.

Intellectual property

The Penman app, website, branding, and the tools' code and design are our property or our licensors'. These terms don't grant you any rights to them beyond using the service as intended.

Disclaimers

The service is provided as-is and as-available, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that transcription or AI output will be accurate, that the service will be uninterrupted, or that sync will never lose data.

Limitation of liability

To the maximum extent permitted by law, Penman and its developers are not liable for indirect, incidental, or consequential damages — including lost data, lost profits, or lost recordings — arising from use of the app or site. Where liability can't be excluded, it is limited to the amount you paid us in the 12 months before the claim (or the minimum permitted by law).

Changes & termination

We may update these terms; the date at the top reflects the latest version and material changes will be announced on this site. We may suspend or end access for violations of these terms. You can stop using the service at any time — deleting the app and clearing your browser data ends it on your side.
